Acceptance of Terms

RestorationInitiative.org is a joint website used by three legally separate organizations: American Restoration Action, American Restoration Foundation, and American Restoration Victory. These organizations are collectively referred to in these Terms as the “Participating Organizations.”

These Terms constitute an agreement between you and the Participating Organization or Organizations responsible for the page, form, communication, feature, or service you use through this website, collectively referred to as the “Site.” In these Terms, “we,” “us,” and “our” refer to the applicable Participating Organization or Organizations.

By accessing, browsing, submitting information through, or otherwise using the Site, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

Eligibility

The Site is intended for users who are at least 13 years old. If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian. The Site is not directed to children under 13, and children under 13 should not submit personal information through the Site.

By using the Site, you represent that you have the legal capacity to agree to these Terms or that your parent or legal guardian has agreed to them on your behalf.

Website Purpose and Informational Content

The Site supports the distinct lawful missions of the Participating Organizations. American Restoration Action conducts social-welfare and advocacy activities. American Restoration Foundation conducts civic, charitable, and educational activities. American Restoration Victory conducts independent political and electoral activities.

The Site may provide information, commentary, educational material, legislative and election updates, opportunities for civic participation, advocacy tools, and ways to support one or more of the Participating Organizations.

Content on the Site is provided for general informational and advocacy purposes. It does not constitute legal, tax, financial, medical, or other professional advice. You should consult an appropriate professional before relying on Site content for decisions requiring professional judgment.

Public policy, legislation, elections, and government actions can change quickly. Although we strive to provide useful and accurate information, we do not guarantee that every item will remain complete, current, or error-free.

Intellectual Property and Permitted Use

Unless otherwise indicated, the Site and its text, graphics, logos, photographs, videos, designs, downloadable materials, and other content are owned by one or more Participating Organizations or used with permission and are protected by applicable intellectual-property laws.

You may access the Site for lawful personal, educational, and noncommercial civic purposes. You may link to public Site pages and share unaltered excerpts for noncommercial discussion when you provide appropriate attribution and do not imply endorsement by any Participating Organization.

You may not reproduce, modify, republish, sell, license, remove attribution from, or commercially exploit substantial portions of Site content without prior written permission. Nothing in these Terms grants you ownership of any American Restoration Initiative or Participating Organization name, logo, trademark, or other protected material.

Prohibited Conduct

You agree not to use the Site to:

• Violate any applicable law, regulation, court order, or legal right.
• Impersonate another person or submit false or misleading identifying information.
• Submit another person’s contact information without authorization.
• Interfere with, disrupt, damage, or attempt to gain unauthorized access to the Site or its systems.
• Introduce malware, malicious code, automated scripts, scraping tools, or excessive requests.
• Use bots or automated methods to submit petitions, forms, messages, or contributions.
• Harass, threaten, defame, or unlawfully target another person or organization.
• Misrepresent your affiliation with or endorsement by any Participating Organization.
• Use Site content or services for unauthorized commercial solicitation or fundraising.
• Assist or encourage anyone else to engage in prohibited conduct.

Petitions, Advocacy Tools, and Submissions

The Site may allow you to sign petitions, send messages to public officials or other recipients, submit forms, provide comments, or participate in similar calls to action. When you use one of these tools, you authorize the Participating Organization responsible for the tool and its service providers to process your submission and transmit the information reasonably necessary to the intended recipient or recipients, as further described in our Privacy Policy and the applicable form.

You represent that information you submit is accurate, that you are submitting it on your own behalf, and that your submission does not violate the rights of another person. The responsible Participating Organization may reject, remove, edit, or decline to transmit a submission that is unlawful, abusive, fraudulent, duplicative, technically harmful, or inconsistent with the purpose of the advocacy tool.

If you voluntarily provide a testimonial, photograph, statement, or other material for possible publication, you grant the Participating Organization receiving it a nonexclusive, royalty-free license to use, reproduce, edit, and display that material for its lawful educational, advocacy, political, fundraising, and promotional purposes. You may withdraw permission for future use by contacting us, although withdrawal will not require removal from materials already produced or distributed.

Email and Mobile Communications

If you provide an email address or mobile number and affirmatively opt in to receive communications, you authorize the Participating Organization or Organizations identified on the form, along with their service providers, to send informational, educational, advocacy, political, fundraising, and organizational messages using the contact information you provide.

Email recipients may unsubscribe using the link provided in an email or by contacting us. Mobile-message frequency may vary, and message and data rates may apply. Consent to receive mobile messages is not a condition of making a contribution or using the Site. You may revoke consent to text messages at any time by replying STOP or by contacting us at info@restorationinitiative.org.

You are responsible for providing accurate contact information and for notifying us if your email address or mobile number changes. Wireless carriers are not responsible for delayed or undelivered messages.

Contributions

The Site may offer opportunities to contribute to one or more Participating Organizations. The applicable contribution page will identify the recipient organization and provide notices, eligibility certifications, tax information, and other terms specific to that recipient. You should review those notices before contributing.

• Contributions to American Restoration Action, a section 501(c)(4) social welfare organization, generally are not deductible as charitable contributions for federal income-tax purposes.
• Contributions to American Restoration Victory are political contributions and are not deductible as charitable contributions. They are subject to applicable federal law and the contributor certifications presented on the contribution form. Contributor information may be publicly disclosed as required by law.
• A contribution to American Restoration Foundation is tax deductible only to the extent permitted by law and only if the Foundation is eligible to receive tax-deductible contributions at the time of the gift. Consult the contribution page, acknowledgment, and your tax adviser for guidance.

Contributions may be processed by a third-party payment provider. Your use of that provider is also subject to its terms, privacy practices, and transaction procedures. The Participating Organizations do not necessarily receive or retain complete payment-card information when it is handled directly by the payment provider.

You represent that all information submitted in connection with a contribution is accurate, that the contribution is lawful, that you are authorized to use the selected payment method, and that you satisfy all certifications displayed on the contribution form. A Participating Organization may reject, refund, or request additional information concerning a contribution when appropriate. Questions should be sent to info@restorationinitiative.org.

Privacy

Our collection, use, and sharing of personal information are described in the American Restoration Initiative Privacy Policy. By using the Site, you acknowledge that information will be handled as described in that policy and in any additional notice presented when information is collected.

Third-Party Services and Links

The Site may link to or rely upon third-party websites, payment processors, advocacy platforms, social networks, analytics services, email or mobile-message providers, and other services that the Participating Organizations do not control. A link or integration does not necessarily constitute an endorsement of the third party or its practices.

Third-party services are governed by their own terms and privacy policies. The Participating Organizations are not responsible for the content, availability, security, accuracy, or practices of third-party services. You use them at your own discretion and risk.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, FEATURES, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE PARTICIPATING ORGANIZATIONS DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

The Participating Organizations do not warrant that the Site will be uninterrupted, secure, error-free, free of harmful components, or that any content will be complete, accurate, or current. Your use of the Site is at your own risk. Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PARTICIPATING ORGANIZATIONS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Your sole remedy for dissatisfaction with the Site is to stop using it.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Participating Organizations and their respective directors, officers, employees, volunteers, contractors, service providers, and agents from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your submissions, your violation of these Terms, or your violation of another person’s rights.

Changes, Suspension, and Termination

We may revise these Terms from time to time by posting an updated version on the Site and changing the “Last updated” date. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

We may modify, suspend, restrict, or discontinue any part of the Site at any time. We may also restrict or terminate access by a user who violates these Terms, creates legal or security risk, or interferes with the operation or mission of the Site. Provisions that by their nature should survive termination will remain in effect.

Governing Law and General Terms

These Terms are governed by applicable federal law and, with respect to a particular dispute, the laws of the state in which the Participating Organization responsible for the activity is organized, without regard to conflict-of-law principles. Any legal proceeding arising from or relating to these Terms or the Site must be brought in a state or federal court with jurisdiction over the applicable Participating Organization, except where applicable law requires otherwise.

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms and the Privacy Policy constitute the entire agreement concerning your use of the Site unless a separate written agreement applies.
